This page states the Terms of Use ("Use") under which you may use the services we provide on the Jobs pages of IberiaX.com, a web page operated by the mercantile company Óle Sites, S.L., with headquarters in Seville, Spain.
These Terms constitute a binding agreement between you and Óle Sites, the company that operates the Web sites iberiax.com, oleonline.com and fotoxtr.com (hereinafter known as the Óle Sites), and whose services are generally based and offered in the Iberian Peninsula. They are considered to be accepted by you each time that you use or access our website or use our services. If you do not accept the Terms as stated below, we advise you strongly not use the websites detailed above or any of the services offered therein.
IberiaX.com, Oleonline.com and Fotoxtr.com are mainly tourist information sites but also offer services related to searching for employment opportunities for both jobseekers and companies with job vacancies. Some websites also include online communities which are not only designed to provide a contact and comment service but also to allow users to interact, offering advice, experiences and interests. The Sites allow Users to create individual profiles, which may include personal information and to provide the choice to make these profiles, or parts of them, public.
Óle Sites may revise these Terms at any time by posting an updated version to this Web page. You should visit this page periodically to review the most current Terms because all updates are binding at all times.
Users who violate these Terms and Conditions may have their access and use of the sites operated by Óle Sites suspended or terminated; this at the sole discretion of the management of Óle Sites.
You must be 16 years of age or older to visit or use any of the sites in any manner, and, if under the age of 18 or the age of majority as that is defined in Your jurisdiction, must use the sites under the supervision of a parent, legal guardian, or other responsible adult.
Use of Our Services
The job posting, CV database and other features of the aforementioned websites may be used only by individuals seeking employment and/or career information and by employers seeking employees. In addition, the IberiaX and Oleonline Communities may be used by individuals for permitted professional and personal networking purposes. All Users agree to not to do the following:
(a) transmit, post, distribute, store or destroy material, including without limitation any Content published on the Óle Sites, in violation of any applicable law or regulation, including but not limited to laws or regulations governing the collection, processing, or transfer of personal information, or in breach of the privacy policy of Óle Sites;
(b) take any action that imposes an unreasonable or disproportionately large load on any Óle Site’s infrastructure;
(c) use any device to navigate or search any Óle Site other than the tools provided by us and which are generally available third party web browsers, or other tools approved by Óle Sites;
(d) use any data mining, robots or similar data gathering or extraction methods;
(e) violate or attempt to violate the security of any Óle Site including attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
(f) forge any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting;
(g) reverse engineer or decompile any parts of any Óle Site;
(h) aggregate, copy or duplicate in any manner any of the content published on the Óle Sites, including expired job postings, other than as permitted by these Terms;
(i) post any content or material that promotes or endorses false or misleading information or illegal activities, or endorses or provides instructional information about illegal activities or other activities prohibited by these Terms and Conditions, such as making or buying illegal weapons, violating someone's privacy, providing or creating computer viruses or pirating media;
(j) post any CV or apply for any job on behalf of another party;
(k) defer any contact from an employer to any agent, agency, or other third party;
(l) set more than one copy of the same CV to public at any one time;
(m) share with a third party any login credentials to any Óle Site;
(n) access data not intended for you or logging into a server or account which you are not authorized to access;
(o) post or submit to any Óle Site any incomplete, false or inaccurate biographical information or information which is not your own;
(p) post content that contains restricted or password-only access pages, or hidden pages or images;
(q) solicit passwords or personally identifiable information from other users;
(r) delete or alter any material posted by any other person or entity;
(s) harass, incite harassment or advocate harassment of any group, company, or individual;
(t) send unsolicited mail or email, make unsolicited phone calls or send unsolicited faxes promoting and/or advertising products or services to any User, or contact any users that have specifically requested not to be contacted by you;
(u) attempt to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to any Óle Site, overloading, "flooding", "spamming", "mailbombing" or "crashing";
(v) promote or endorse an illegal or unauthorized copy of another person's copyrighted work, such by as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files; or
(w) use the Óle Sites for any unlawful purpose or any illegal activity, or post or submit any content, CV, or job posting that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind; or-
(x) post any CV which is not a genuine CV and which attempts to advertise or promote products or services.
Violations of system or network security may result in civil and/or criminal liability. Óle Sites will investigate occurrences which may involve such violations and may involve law enforcement authorities in prosecuting users who are involved in such violations.
3. Conditions Applicable to Employers
You are responsible for maintaining the confidentiality of your employer account, Profile and passwords, as applicable. You may not share your password or other account access information with any other party, temporarily or permanently, and you shall be responsible for all uses of registrations and passwords, whether or not you have authorized them. You provide your agreement to immediately notify Óle Sites of any unauthorized use of your employer account, profile, or passwords.
Employers are solely responsible for all their postings on Óle Sites and none of these sites should be considered to be an employer with respect to your use and shall not be held responsible for any employment decisions, for whatever reason, made by any entity posting jobs on any Óle Site.
You understand and acknowledge that your employer account is cancelled or terminated by you, all your account information, including saved CVs, network contacts, and email mailing lists, may be deleted from Óle Sites’ databases although information may continue to be available for some period of time due to any delay in deletion propagating through Óle Sites’ web servers.
In order to protect our users from commercial advertising or solicitation, Óle Sites reserves the right to restrict the number of e-mails which an employer may send to users to an amount deemed appropriate; this at the sole discretion of Óle Sites.
Candidate profiles may also be made available through the Sites. No representation regarding the accuracy or validity of such works or their appropriateness for evaluation by employers is claimed by Óle Sites. You should be aware that derived profiles may vary significantly from user Content.
Job Listings
A Job listing may not contain:
(a) hyperlinks, other than those specifically authorized by Óle Sites;
(b) misleading, unreadable, or "hidden" keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented, as reasonably determined by Óle Sites;
(c) the names, logos or trademarks of unaffiliated companies other than those of your customer save where expressly agreed by the service provider;
(d) the names of colleges, cities, states, towns or countries that are unrelated to the posting;
(e) inaccurate, false, or misleading information; and
(g) material or links to material that exploits people in a sexual, violent or other manner
(h) material that solicits personal information from anyone under 16.
You may not use your job listing to:
(a) post jobs in a manner that does not comply with applicable local, national and international laws, including but not limited to laws relating to labour and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, or intellectual property;
(b) post jobs that require citizenship of any particular country or lawful permanent residence in a country as a condition of employment, unless otherwise required in order to comply with law, regulations or other executive orders;
(c) post jobs that include any screening requirement or criterion in connection with a job posting where such requirement or criterion is not an actual and legal requirement of the posted job;
(d) post jobs or other advertisements for competitors of Óle Sites or post jobs or other content that contains links to any site which may be in competition with Óle Sites;
(e) sell, promote or advertise products or services;
(f) post any franchise, pyramid scheme, "club membership", distributorship, multi-level marketing opportunity, or sales representative agency arrangement;
(g) post any business opportunity that requires an up-front or periodic payment or requires recruitment of other members, sub-distributors or sub-agents;
(h) post any business opportunity that pays commission only unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the job seeker would be selling;
(i) promote any opportunity that does not represent bona fide employment;
(j) advertise sexual services or seek employees for jobs of a sexual nature;
(k) request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy;
(l) endorse a particular political party, political agenda, political position or issue;
(m) promote a particular religion;
(n) post jobs located in countries subject to economic sanctions of Europe or the United States of America; and
(o) except where allowed by applicable law, post jobs which require the applicant to provide information relating to his/her (i) racial or ethnic origin (ii) political beliefs(iii) philosophical or religious beliefs (iv) membership of a trade union (v) physical or mental health (vi) sexual life (vii) the commission of criminal offences or proceedings or (vii) age.
Óle Sites reserve the right to remove any job listing or content from any of their websites, which in the reasonable exercise of Óle Sites’ discretion, does not comply with the above Terms, or if any content is listed that Óle Sites believes is not in their own best interest.
If at any time during your use of the Services, you make or made a misrepresentation of fact, or otherwise misled Óle Sites in regards to the nature of your business activities, Óle Sites reserve the exclusive right to terminate your use of the Services provided.
CV Database
Use of the Óle Sites CV Database by Employers
You shall use the CV Database provided by Óle Sites as provided in these Conditions and in any contract you have with Óle Sites. You undertake to use the Óle Sites CV Database in accordance with all applicable privacy and data protection laws, and agree not to further disclose any of the data from the Database to any third party, unless you are an authorized recruitment agency, staffing agency, advertising or other agency or using the CV explicitly for employment purposes.
You shall take appropriate physical, technical, and administrative measures to protect data obtained from Óle Sites CV Database from loss, misuse, unauthorized access, disclosure, alteration or destruction. You shall not share the CV Database login credentials with any other party.
The CV Database shall not be used:
(a) for any purpose other than as an employer seeking employees, including but not limited to advertising promotions, products, or services to any CV holders;
(b) to make unsolicited phone calls or faxes or send unsolicited mail, email, or newsletters to CV holders or to contact any individual unless they have agreed to be contacted (where consent is required or, if express consent is not required, who has informed you that they do not want to be contacted); or
(c) to source candidates or to contact job seekers or CV holders in regards to career fairs and business opportunities prohibited by Section 3.
In order to ensure a safe and effective experience for all of our customers, we exclusively reserve the to limit the amount of data (including CV views) that may be accessed by you in any given time period. These limits may be amended at the sole discretion of Óle Sites as required.
4. Additional Terms Applicable to Job Seekers
When you register with Óle Sites, you will be asked to create an account and provide certain information including, without limitation, a valid email address (Your "Information").
Any profile you submit must be accurate and describe you as an individual person. The profile requires standard fields to be completed and you may not include in these fields any telephone numbers, street addresses, email addresses or other means of contacting you other than your last name and URLs.
You acknowledge and agree that you are solely responsible for the form, content and accuracy of any CV or material contained therein placed by you on any Óle Sites.
Óle Sites reserves the right to offer third party services and products to users based on the preferences identified in the registration process and at any time thereafter, or you have agreed to receive, such offers may be made by Óle Sites or by any approved third parties. Please see Óle Site’s Privacy Policy or further details regarding the safety of any information that you submit.
You understand and acknowledge that you have no ownership rights in your account and that if your account is cancelled or terminated, all your account information held on Óle Sites servers, including CVs, Profiles, cover letters, saved jobs, questionnaires will be marked as deleted in and may be deleted from our databases. All said information will be removed from any public area of Óle Sites. Information may continue to be available for some period of time because of delays in propagating such deletion through our web servers. In addition, you acknowledge that you are aware that third parties may retain saved copies of any information displayed on your account during its phase of activity.
Óle Sites reserves the right to delete your account and all of your information after a period of inactivity considered by the management of Óle Sites to be significant.
5. User Content and Submissions
You understand that all information, data, text, software, music, sound, photographs, graphics, video, advertisements, messages or other materials submitted, posted or displayed by you on or through Óle Sites is the sole responsibility of the person from which such content originated.
Óle Sites claims no ownership or control over any such content. You or a third party licensor, as appropriate, retain all patent, trademark and copyright to any user content submitted, posted or displayed on or through Óle Sites and you are responsible for protecting those rights, as appropriate. By submitting, posting or displaying such content on Óle Sites, you grant Óle Sites a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such content through any Óle Site.
In addition, by submitting, posting or displaying user content which is intended to be available to the general public, you grant Óle Sites a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish said content for the purpose of promoting Óle Sites and its services in relation to the advertising or acquisition of employment. Óle Sites undertakes to discontinue this licensed use within a commercially reasonable period after such user generated content is removed from iots servers.
If you post user generated content in any public area of any Óle Site, you also permit any other user to access, display, view, store and reproduce such content for personal use.
Subject to the foregoing, the owner of the original content placed on any Óle Site retains any and all rights that may exist in such content. Óle Sites may review and remove any user content that, in its sole judgment, violates these Terms, violates applicable laws, rules or regulations, is abusive, disruptive, offensive or illegal, or violates the rights of, or harms or threatens the safety of users of any Óle Site.
It should be understood that Óle Sites reserves the right to expel any user and prevent their further access to the Óle Sites and/or use of any of the Óle Services for violating the Terms or applicable laws, rules or regulations of any country in which the Óle Sites websites are published. Óle Sites may take any action with respect to any content should it be deemed necessary or appropriate at its sole discretion. This is especially true if Óle Sites believes that such content could create liability or damage Óle Site’s brand or public image, or cause Óle to lose other users or (in whole or in part) the services of its ISPs or other suppliers.
Óle Sites does not represent or guarantee the truthfulness, accuracy, or reliability of any content, derivative works or any other communications posted by users nor does Óle Sites endorse any opinions expressed any content other than that published by its own servants. You acknowledge that any reliance on material posted by other users will be at your own risk.
Any User Content submitted to Monster Communities, no information that may be interpreted as a direct solicitation, advertisement or recruitment for an available job position directed to individuals seeking employment on either a full time or part time basis may be included. In order to protect our Óle Sites users from commercial advertising or solicitation, Óle Sites reserves the right to restrict the number of e-mails or other messages which any user may send to other users to a number which is deemed appropriate at the sole discretion of Óle Sites.
We welcome comments regarding our services. It should be noted that any unsolicited submissions, of whatever nature made to Óle Sites will be considered to be within the intellectual property of Óle Sites and sole discretion of the Óle Sites management will be used to decide whether or not compensation is made in exchange for any submission considered to be commercially valuable.
6. Liability
Óle Sites act as, among other things, venues for (i) employers to post job opportunities and search for and evaluate job candidates and (ii) candidates to post CVs and Profiles and search for and evaluate job opportunities. None of the listings submitted to Óle Sites are screened or censored. Óle Sites is not involved in the actual transaction between employers and candidates. As a result, Óle Sites is not responsible for any user content, the quality, safety or legality of the jobs or CVs posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings.
Further, Óle Sites makes no representations about any jobs, CVs or user content posted on the Óle Sites. While Monster reserves the right in its sole discretion to remove any content, job postings, CVs or other material from time to time, Óle Sites does not assume any obligation to do so and to the extent permitted by law, disclaims any liability for failing to take any such action.
Note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Óle Sites. By its very nature other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. You are expected to use caution and common sense when using the service provided by Óle Sites.
Because authentication of users on the Internet can be difficult, Óle Sites cannot and does not confirm that any user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants, in the event that there is a dispute with one or more users, you specifically release Óle Sites and its servants from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes to the fullest extent permitted by law.
Content offered on the Óle Sites may contain inaccuracies or typographical errors. Óle Sites makes no representations about the accuracy, reliability, completeness, or timeliness of any Óle Site or the Óle Site content. The use of all information displayed on any of the Óle Sites is at your own risk. Changes are periodically made to Óle Sites and may be made at any time. Óle Sites does not either guarantee or promise any specific results from the use of its services. No advice or information, whether oral or written, obtained by a user from any Óle Sites shall constitute any guarantee or warranty not expressly stated herein.
The particular focus of Óle Sites is the Iberian Peninsula. Óle Sites does not accept any liability for regulations, laws or Civil Codes other than those specifically relating to the Iberian Peninsula. Generally, Óle Sites will not publish information relating to jobs that are available outside the Iberian Peninsula, although from time to time, jobs may be posted that are not directly related to employment in the Iberian Peninsula. In such cases, the above applies and you acknowledge that Óle Sites must be held free from any action, compensation or liability relating from the publication of said positions.
In no event shall Óle Sites be liable for the deletion, loss, or unauthorized modification of any user content, files that have been uploaded to its servers or any other information relating to or being used in the services offered by Óle Sites.
Óle Sites does not provide or make any representation as to the quality or nature of any of the third party products or services offered or purchased through any Óle Site, or any other representation, warranty or guarantee. Any such undertaking, representation, warranty or guarantee must be furnished solely by the provider of such third party products or services, under the terms agreed to or offered by the provider.

7. Disclaimer of Warranty
By using any of the Óle Sites, you should be aware that Óle Sites, to the fullest extent permitted by law, does not guarantee that any of the sites or services will operate error-free or that the any of the sites, or the servers on which the sites are located, are free of computer transmittable viruses or other harmful mechanisms as yet unknown. Óle Sites accepts no liability or cost for the loss of any information or equipment that may require replacement as a result of using any Óle Site or the services offered on any of those sites.
The services offered on the Óle Sites are offered as an ‘as is’ service and no guarantees or warranties of any kind are offered. Further, Óle Sites makes no claim or guarantees as to the effectiveness of any of the information, whatever its nature, or services offered on any of the Óle Sites.
8. Disclaimer of Consequential Damages
By using any of the Óle Sites, you should be aware that, to the fullest extent permitted by law, neither Óle Sites nor any of its suppliers, third party providers mentioned on any Óle Site, shall not accept in any event, any damages whatsoever (including but not limited to, incidental or consequential damages, loss of profits or damages arising from the loss of data or information, lost employment opportunity or business interruption) resulting from either the use or inability to use any Óle Sites service or content, even if Óle Sites is pre-advised of the possibility of such damages.
9. Limitation of Liability
TO THE FULLEST EXTENT POSSIBLE BY LAW, ÓLE SITES MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY ÓLE SITE OR THE USE OF ANY CONTENT RECORDED ON ANY ÓLE SITES SERVER, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED 50€.

11. No Resale or Unauthorized Commercial Use
You agree not to resell or assign your rights or obligations under these Terms and Conditions. You also agree not to make any unauthorized commercial use of any Óle Site.
12. General
These Terms and Conditions are governed by the laws of Spain. Jurisdiction for any claims arising under this agreement shall lie exclusively with the courts of Seville, Spain. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. In addition, failure to enforce any term of these Terms and Conditions shall not be deemed as a waiver of such term or otherwise affect Óle Sites’ ability to enforce such term at any point in the future. Except as expressly provided in an additional agreement, additional Terms and Conditions for certain areas of the Óle Sites including the Privacy Policy (http://www.iberiax.com/contact-us/privacy-policy), software licenses or material on particular pages of any Óle Site, these Terms and Conditions constitute the full agreement between you and Óle Sites with respect to the use of any of the Sites listed above.
Changes to these Terms and Conditions shall be made at the sole discretion of Óle Sites and a revised posting will be placed on this page. Please check this page frequently to ensure that you are aware of the latest set of Terms and Conditions for use of any of the Óle Sites that may apply.
13. Additional Terms
Óle Sites uses third party software that may be subject to additional Terms. By using such areas, or any part thereof, you agree to be bound by any additional Terms and Conditions applicable to such areas. For example, by using any areas of this website or the other Óle Sites that contain Google Maps, you agree to be bound by the Google Maps Terms of Use available at http://maps.google.com/help/terms_maps.html and the legal notices available at http://www.maps.google.com/help/legalnotices_maps.html. 14. Term and Termination
These Terms and Conditions will remain in full force and effect while you remain a user of any Óle Site. At its sole discretion, Óle Sites reserves the right to pursue all of its legal remedies, including but not limited to removal of any content posted by you from any of the Óle Sites as well as immediate termination of your registration with or ability to access the Community sections of the Óle Sites and/or any other services provided to you by any of the Óle Sites, upon any breach by you of these Terms and Conditions or any information provided by you is unable to be verified or authenticated during the process of Registration.
